【摘要】：仲裁是國際商事仲裁以及學(xué)術(shù)研究中的核心用語。在國際商事的領(lǐng)域中,仲裁更是得到了廣闊的發(fā)展空間,并且憑借仲裁具有的訴訟不具有的無可比擬的優(yōu)點(diǎn)在國際商事的交易雙方中都得到青睞,在遇到國際商事糾紛的時(shí)候,絕大多數(shù)的當(dāng)事人會(huì)把糾紛的案件交給自己中意的仲裁庭來解決問題。雖然仲裁已經(jīng)成為一種非�？煽壳曳浅Ｊ軞g迎的一種糾紛解決方式,但無論國際商事仲裁還是國內(nèi)仲裁,都無法回避其與法院兩者之間的關(guān)系的問題。國際商事仲裁的司法審查可以促進(jìn)國際商事仲裁公正和合法化目標(biāo),也可以有效地防止惡意的當(dāng)事人或者仲裁員破壞或延誤仲裁程序,加快仲裁的進(jìn)程。1同時(shí)、另外一個(gè)不得不提的問題就是對(duì)國際商事仲裁的司法審查必須是合理的,然而在我國的商事仲裁中,在日新月異的國際商事仲裁不斷發(fā)展的進(jìn)程中,我國的商事仲裁的相關(guān)法律規(guī)定還不能很好與國際商事仲裁制度靠攏,還存在許多這樣那樣的缺陷。在構(gòu)建和諧的國際商事仲裁的大背景下,本選題對(duì)國際商事仲裁制度和我國的商事仲裁制度進(jìn)行實(shí)證分析研究后,針對(duì)我國的商事仲裁制度存在的問題提出相應(yīng)的改進(jìn)思路和措施,對(duì)我國的商事仲裁制度的發(fā)展有一定的積極意義。本文共包括五個(gè)部分: 第一部分:對(duì)國際商事仲裁進(jìn)行分割,分別進(jìn)行解釋,“國際”、“商事”和“仲裁”,由于各國的具體國情和法律習(xí)慣的不同,一般的各國法律規(guī)定不同,但總的趨勢(shì)是趨于廣義。這一部分的最后將對(duì)我國的相關(guān)規(guī)定進(jìn)行研究和闡述,隨著我國對(duì)外貿(mào)易交流不斷的擴(kuò)大,由于不同的規(guī)定在不同的國家可能會(huì)引起糾紛和爭(zhēng)議,在這里會(huì)舉例進(jìn)行分析。 第二部分:從國際商事仲裁審查概念切入,從理論上尋找國際商事仲裁司法審查的依據(jù)。理論界對(duì)國際商事仲裁的性質(zhì)的觀點(diǎn)主要有四種:契約論、司法論、契約司法混合論和自治論,最后將論述在仲裁理論和實(shí)踐中我國對(duì)國際商事仲裁的主流看法。 第三部分:從古代仲裁的雛形到如今仲裁形成一種固定的爭(zhēng)議解決制度,是一個(gè)不斷發(fā)展的過程。也就是在仲裁不斷成長過程中,不得不面對(duì)仲裁與法院的關(guān)系。本部分主要闡述仲裁和法院之間的關(guān)系發(fā)展過程,以及法院審查國際商事仲裁的原因。 第四部分:各國一般都要自己國家的商事仲裁進(jìn)行審查,本部分將對(duì)國際商事仲裁審查的內(nèi)容進(jìn)行分析,對(duì)國際商事仲裁審查基本上是從仲裁的主要環(huán)節(jié)入手的。 第五部分:從國際商事仲裁過渡到我國的商事仲裁制度,以我國的實(shí)踐為出發(fā)點(diǎn),分析我國商事仲裁制度中存在的主要缺陷,并提出對(duì)我國商事仲裁制度進(jìn)行完善提出相應(yīng)的思路和措施。
[Abstract]:Arbitration is the core language of international commercial arbitration and academic research. In the field of international commercial affairs, arbitration has got a broad space for development, and by virtue of the unparalleled advantages of arbitration in litigation, it has been favored by both parties in international commercial transactions, and when it comes to international commercial disputes, The vast majority of parties will dispute the case to their own preferred arbitration tribunal to resolve the problem. Although arbitration has become a very reliable and very popular way to resolve disputes, neither international commercial arbitration nor domestic arbitration can avoid the question of the relationship between arbitration and the court. Judicial review of international commercial arbitration can promote the objective of fairness and legalization of international commercial arbitration, can also effectively prevent malicious parties or arbitrators from disrupting or delaying arbitration proceedings, and speed up the process of arbitration .1 at the same time, Another problem that has to be raised is that the judicial review of international commercial arbitration must be reasonable. However, in our country's commercial arbitration, in the course of the rapid development of international commercial arbitration, The relevant laws and regulations of commercial arbitration in our country are still not close to the international commercial arbitration system, and there are still many defects. Under the background of constructing harmonious international commercial arbitration, this thesis makes an empirical analysis of the international commercial arbitration system and the commercial arbitration system of our country. In view of the problems existing in the commercial arbitration system of our country, this paper puts forward the corresponding improvement ideas and measures, which is of certain positive significance to the development of the commercial arbitration system in our country. This paper consists of five parts: The first part: the international commercial arbitration is divided into two parts: "international", "commercial" and "arbitration". But the general trend tends to be broad. At the end of this part, we will study and expound the relevant regulations of our country. With the expansion of our foreign trade exchange, different regulations may cause disputes and disputes in different countries. The second part: from the concept of international commercial arbitration review, from the theoretical basis of judicial review of international commercial arbitration. There are four kinds of views on the nature of international commercial arbitration: contract theory, judicial theory, contract judicial mixed theory and autonomy theory. At last, we will discuss the mainstream view of international commercial arbitration in our country in the arbitration theory and practice. The third part: from the embryonic form of ancient arbitration to the formation of a fixed dispute settlement system, it is a developing process. That is, in the growing process of arbitration, we have to face the relationship between arbitration and the court. This part mainly expounds the development process of the relationship between arbitration and court, and the reason why the court reviews international commercial arbitration. The fourth part: each country generally wants their own country's commercial arbitration to carry on the examination, this part will carry on the analysis to the international commercial arbitration review, the international commercial arbitration review basically starts from the arbitration main link. The fifth part: from the international commercial arbitration to the commercial arbitration system of our country, taking the practice of our country as the starting point, analyzes the main defects in the commercial arbitration system of our country. And put forward the corresponding ideas and measures to perfect the commercial arbitration system of our country.
