【摘要】：立案登記制改革實(shí)現(xiàn)了我國(guó)法院受案模式從職權(quán)主義向訴權(quán)保障主義的轉(zhuǎn)變,較好化解了"立案難"問(wèn)題。立案登記制改革后出現(xiàn)的案多人少影響審理質(zhì)量、訴權(quán)濫用追問(wèn)應(yīng)對(duì)舉措、棘手案件考驗(yàn)審理能力、定紛機(jī)制探求新的平衡等問(wèn)題總體上是改革發(fā)展中的問(wèn)題,其背后存在社會(huì)認(rèn)知不足、資源配置不足、工作創(chuàng)新不足、制度配套不足等四大原因。破解這些問(wèn)題需從深化省以下司法體制改革、強(qiáng)化人民法院司法能力、細(xì)化立案登記制制度設(shè)計(jì)、優(yōu)化法院內(nèi)部資源配置、催化多元糾紛處置機(jī)制等方面著手,為立案登記制改革創(chuàng)造更好的法治生態(tài)。
[Abstract]:The reform of filing registration system has realized the transformation of the mode of court receiving cases from the principle of authority to the principle of safeguarding the right of action, and solved the problem of "filing case". After the reform of the registration system, the problems of more cases and fewer people affecting the quality of the trial, the abuse of the right of action and the measures to deal with it, the test of the trial ability of the intractable cases, and the search for a new balance in the dispute settlement mechanism are overall problems in the development of the reform. There are four reasons behind it, such as insufficient social cognition, insufficient allocation of resources, insufficient innovation of work and insufficient supporting system. To solve these problems, we should deepen the reform of the judicial system below the provincial level, strengthen the judicial capacity of the people's court, refine the design of the registration system for filing a case, optimize the allocation of resources within the court, and catalyze the resolution mechanism of multiple disputes, etc. For the registration system reform to create a better ecological rule of law.
