【摘要】：通過(guò)對(duì)農(nóng)村居民融資現(xiàn)狀的實(shí)證考察，筆者發(fā)現(xiàn)允許農(nóng)村土地承包經(jīng)營(yíng)權(quán)與宅基地使用權(quán)的抵押融資是解決農(nóng)村居民面臨融資難這一困境的必然選擇。但是允許農(nóng)村土地“雙權(quán)”的抵押融資，并非簡(jiǎn)單的修改現(xiàn)行法律規(guī)定既可，除法律障礙外，必須要克服土地承包經(jīng)營(yíng)權(quán)與宅基地使用權(quán)的人役性，土地使用權(quán)權(quán)利的不穩(wěn)定，土地使用權(quán)的行使受到農(nóng)村集體經(jīng)濟(jì)組織影響較大，土地使用權(quán)抵押缺乏專(zhuān)門(mén)的政策性銀行的對(duì)口支持，，農(nóng)村土地流轉(zhuǎn)難，銀行等金融機(jī)構(gòu)的抵押權(quán)變現(xiàn)難等一系列障礙。 因此，要建立、健全我國(guó)的農(nóng)村土地使用權(quán)抵押制度就必須修改現(xiàn)行的法律，否則各地在中央政策支持下展開(kāi)的土地使用權(quán)抵押試點(diǎn)都有違現(xiàn)行法律規(guī)定，農(nóng)村土地使用權(quán)抵押的合法性都會(huì)受到質(zhì)疑。為此應(yīng)該修改現(xiàn)行法律關(guān)于農(nóng)村土地使用權(quán)抵押的規(guī)定，去除農(nóng)村土地使用權(quán)的人役性，做實(shí)其財(cái)產(chǎn)屬性，還原其用益物權(quán)的本質(zhì)。在配套制度建設(shè)方面，還要建立農(nóng)村土地流轉(zhuǎn)的配套機(jī)制如農(nóng)村土地使用權(quán)的確權(quán)登記、土地價(jià)值的評(píng)估機(jī)制等。此外，我國(guó)可以借鑒國(guó)外成熟的農(nóng)地金融制度，建立專(zhuān)門(mén)的政策性銀行——土地銀行為農(nóng)村居民的融資進(jìn)行對(duì)口支持。
[Abstract]:Through the empirical investigation of the current situation of rural residents' financing. The author finds that it is an inevitable choice to allow the right of rural land contract management and the right to use the homestead to mortgage finance, but to allow the "double right" mortgage financing of rural land is the inevitable choice to solve the dilemma that rural residents are faced with financing difficulties. In addition to legal obstacles, we must overcome the human servitude of land contractual management right and the right to the use of homestead, and the instability of the right to the use of land. The exercise of land use right is greatly affected by rural collective economic organizations, land use right mortgage lack of special policy bank support, rural land circulation is difficult. Banks and other financial institutions such as the realization of mortgage difficult to wait for a series of obstacles. Therefore, in order to establish and perfect the mortgage system of rural land use right in China, we must modify the current law, otherwise, the pilot projects of land use right mortgage carried out in various places under the support of central policies are in violation of the current legal provisions. The validity of the right to use rural land mortgage will be questioned. Therefore, we should modify the current law on the mortgage of rural land use right, remove the human servitude of the rural land use right, and make sure its property attribute. To restore the essence of usufruct. In the construction of supporting system, we should also establish the supporting mechanism of rural land circulation, such as the registration of the right to use rural land, the evaluation mechanism of land value, and so on. Our country can draw lessons from the mature agricultural land financial system abroad, and establish a special policy bank-Land Bank to support the financing of rural residents.
