【摘要】："城市的土地屬于國(guó)家所有"是附條件的義務(wù)性規(guī)范,義務(wù)是城市的土地國(guó)有化。實(shí)現(xiàn)義務(wù)的條件是:納入城市范圍、國(guó)家為了公共利益依法有償征收。按憲法原旨,"城市"應(yīng)解釋為"直轄市、設(shè)區(qū)的市中的城區(qū)及不設(shè)區(qū)的市"。"國(guó)家所有權(quán)"是憲法和物權(quán)法上的所有權(quán)。依照"城市土地應(yīng)當(dāng)屬于國(guó)有"的解釋及對(duì)公共利益的廣義解釋,"征地悖論"可以被化解。未依法有償征收的土地不能國(guó)有化,所以城中村的土地在被征收之前,屬于農(nóng)村集體所有,應(yīng)當(dāng)按照憲法的規(guī)定區(qū)別對(duì)待城中村。城中村中符合征收條件的土地不宜直接入市,可以入市的主要為城區(qū)外的城郊及農(nóng)村的土地,撤縣設(shè)區(qū)不能直接帶來(lái)土地權(quán)屬的改變。
[Abstract]:"the land of a city belongs to the state" is a conditional compulsory norm, and the obligation is the nationalization of the land of a city. According to the original constitutional intent, the term "city" shall be interpreted as "a municipality directly under the Central Government," "State ownership" is the ownership of the Constitution and property Law. According to the interpretation of "Urban land should belong to the state" and the broad interpretation of the public interest, "land expropriation paradox" can. The land that has not been expropriated for compensation according to law cannot be nationalized. Therefore, the land of the village in the city is owned by the rural collectives before it is expropriated. It should be treated differently in accordance with the provisions of the Constitution. The land in the village in the city that meets the conditions for expropriation is not suitable for direct entry into the market. The main land that can enter the city is the suburb outside the urban area and the rural land, and the land ownership can not be changed directly.
