【摘要】：正學(xué)界論述司法裁判技巧,動輒將關(guān)注點(diǎn)投向復(fù)雜案件和疑難案件。誠然,因這類案件的典型性,故法官對相關(guān)案件的裁判,更容易投注創(chuàng)造心智;學(xué)者研究這些裁判,也容易從中獲得新知。但陽春白雪雖好,莫奈何下里巴人。對絕大多數(shù)法官而言,恰恰面對的是日常的簡單案件。能否嫻熟地運(yùn)用司法技巧把日常案件處理妥當(dāng),或許是絕大多數(shù)法官安身立命的不二法門。同時,由于法律自身作為一個道義
