【摘要】：伴隨著全球經(jīng)濟的快速發(fā)展，各種廢物層出不窮，廢物的數(shù)量也與日俱增。經(jīng)濟發(fā)展的速度已經(jīng)遠遠超出了人類解決自身問題的能力，發(fā)達國家環(huán)境立法起步早，環(huán)境保護意識強，，處置費用昂貴，這就使得發(fā)達國家不斷將廢物從本國轉移到其他國家尤其是發(fā)展中國家。從上世紀70年代以來廢物的非法越境轉移及處置現(xiàn)象屢禁不止，給受害國的環(huán)境和人民的健康帶來了諸多損害。廢物的產生不可能完全避免，只有加強立法、發(fā)展循環(huán)經(jīng)濟才能有效應對發(fā)展帶來的環(huán)境挑戰(zhàn)，實現(xiàn)人類的可持續(xù)發(fā)展。通過各方的共同努力，國際社會相繼制定了以《巴塞爾公約》為代表的控制廢物越境轉移及其處置的國際公約。各國特別是發(fā)展中國家也加強了相關的立法工作，對遏制廢物的非法越境轉移與處置，維護了各國的環(huán)境主權發(fā)揮了重要作用。 本文共分五個部分。第一部分導論介紹了本文的選題背景，研究方法及論文的創(chuàng)新之處。第二部分界定了相關概念，分析了控制廢物越境轉移及其處置法律制度中的主要內容。第三部分介紹了我國控制廢物越境轉移及其處置法律制度的現(xiàn)狀，分析了我國現(xiàn)行制度的特點和缺陷，用案例分析的方法介紹了現(xiàn)行制度的實施。第四部分首先介紹了控制廢物越境轉移與處置的域外法律制度，其次提出了國外立法值得借鑒之處。第五部分是對我國控制廢物越境轉移及其處置法律制度的完善提出的建議。
[Abstract]:With the rapid development of the global economy, various kinds of waste emerge one after another, and the quantity of waste is increasing day by day. The speed of economic development has far exceeded the ability of human beings to solve their own problems. Environmental legislation in developed countries started early, environmental protection awareness was strong, and disposal costs were expensive. This allows developed countries to constantly transfer waste from their own countries to other countries, especially developing countries. Since the 1970s, the illegal transboundary movement and disposal of wastes has repeatedly been prohibited, which has caused a lot of damage to the environment and the health of the people in the affected countries. The generation of waste can not be avoided completely. Only by strengthening legislation and developing circular economy can we effectively deal with the environmental challenges brought by development and realize the sustainable development of human beings. Through the joint efforts of all parties, the international community has successively formulated an international convention on the control of transboundary movements of wastes and their disposal, represented by the Basel Convention. Countries, especially developing countries, have also strengthened their legislative work, which plays an important role in curbing the illegal transboundary movement and disposal of wastes and safeguarding their environmental sovereignty. This paper is divided into five parts. The first part introduces the background, research method and innovation of this paper. The second part defines the related concepts and analyzes the main contents of the legal system to control the transboundary movement of wastes and their disposal. The third part introduces the present situation of the legal system of controlling the transboundary movement of waste and its disposal in China, analyzes the characteristics and defects of the current system in China, and introduces the implementation of the current system with the method of case analysis. The fourth part first introduces the extraterritorial legal system to control the transboundary movement and disposal of waste, and then points out that foreign legislation should be used for reference. The fifth part is the suggestion to perfect the legal system of controlling the transboundary movement of waste and its disposal in China.
