【摘要】：隨著城市化進(jìn)程的日益推進(jìn)，城中村作為一種特殊的村落出現(xiàn)在我國迅速發(fā)展的城市中，阻礙了城鄉(xiāng)一體化的發(fā)展。改造城中村勢在必行，然而城中村是我國城鄉(xiāng)二元制度結(jié)構(gòu)與相關(guān)制度缺陷的一個(gè)縮影，，改造城中村困難重重。作為我國城市化發(fā)展中的特有現(xiàn)象，城中村的形成原因和現(xiàn)存問題都是多方面的，其中，土地使用權(quán)問題是城中村研究的核心問題。城中村現(xiàn)象的形成、顯現(xiàn)、發(fā)展和改造是與城中村土地使用制度的變遷密切相關(guān)的。 近年來，學(xué)者們對城中村的研究主要集中在經(jīng)濟(jì)學(xué)和社會學(xué)的內(nèi)容方面，在一定程度上忽略了法律方面的探討。本文從法律層面上研究城中村改造問題，分析城中村土地使用的現(xiàn)狀特征及存在的問題，在找出形成城中村土地不合理使用的制度因素的基礎(chǔ)上提出城中村土地使用權(quán)制度創(chuàng)新的模式，從而在制度創(chuàng)新層面上揭示了城中村改造的新機(jī)制。
[Abstract]:As the urbanization process advances , the village as a special village appears in the rapidly developing city of China , which has hindered the development of urban and rural integration . However , the village is one of the main problems in the development of urbanization in China . However , the problem of land use right is the core problem in the study of urban and rural villages . The formation , appearance , development and transformation of village phenomenon in the city are closely related to the change of the land use system in the village . In recent years , scholars have mainly focused on the contents of economics and sociology , and neglect the legal aspects to a certain extent . In this paper , the author studies the problems of village reconstruction in the city , analyzes the present situation and existing problems of the land use in the village , and puts forward the mode of the system innovation of the land use right system in the village and the village , and reveals the new mechanism of the transformation of the village and the village in the system innovation level .
