【摘要】: 《中華人民共和國物權(quán)法》的頒布,宣示了土地承包經(jīng)營權(quán)的物權(quán)屬性,確立了土地承包經(jīng)營權(quán)的用益物權(quán)地位。同時,為我國土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的完善提供了新的視角。穩(wěn)定土地承包經(jīng)營權(quán)流轉(zhuǎn)制度,建立土地承包經(jīng)營權(quán)流轉(zhuǎn)的長效機制,依法維護土地承包人的各項權(quán)利,是農(nóng)村社會穩(wěn)定和發(fā)展的基礎(chǔ),也是構(gòu)建和諧農(nóng)村的重要內(nèi)容。 但當前土地承包經(jīng)營權(quán)流轉(zhuǎn)的各地法律實踐,暴露出土地承包經(jīng)營權(quán)流轉(zhuǎn)法律制度的諸多問題。如何從《物權(quán)法》的角度分析并完善土地承包經(jīng)營權(quán)流轉(zhuǎn),是當前新的課題。 對土地承包經(jīng)營權(quán)的物權(quán)屬性分析,解讀土地承包經(jīng)營權(quán)的物權(quán)效力,從而擴寬土地承包經(jīng)營權(quán)流轉(zhuǎn)過程中救濟的途徑;以否定土地承包經(jīng)營權(quán)抵押為流轉(zhuǎn)方式,結(jié)合構(gòu)建土地承包經(jīng)營權(quán)的入股制度,提出允許土地承包經(jīng)營權(quán)繼承的觀點,以期對完善土地承包經(jīng)營權(quán)的流轉(zhuǎn)提出有益的建議;土地承包經(jīng)營權(quán)的物權(quán)登記制度的完善,輔以土地承包經(jīng)營權(quán)非訴解決機制的構(gòu)建,更加有力地保障土地承包人的合法權(quán)益。
[Abstract]:The promulgation of the property Law of the people's Republic of China declares the property right attribute of the land contractual management right and establishes the usufruct right status of the land contractual management right. It provides a new angle of view for perfecting the circulation system of land contract management right in our country, stabilizing the transfer system of land contract management right, establishing a long-term mechanism of land contract management right circulation, and safeguarding the rights of land contractor according to law. It is the foundation of rural social stability and development, and also the important content of constructing harmonious countryside. However, the current legal practice of the transfer of land contractual management right has exposed many problems in the legal system of land contract management right circulation. How to analyze and perfect the transfer of land contractual management right from the angle of "Real right Law" is a new subject at present. This paper analyzes the property attribute of the land contract management right, interprets the real right effect of the land contract management right, so as to widen the relief way in the process of land contract management right circulation, and to negate the land contract management right mortgage as the circulation mode, Combined with the construction of the ownership system of the land contractual management right, this paper puts forward the viewpoint of allowing the land contract management right to inherit, in the hope of putting forward some useful suggestions to improve the circulation of the land contract management right, the perfection of the real right registration system of the land contract management right, the improvement of the real right registration system, With the construction of non-litigation settlement mechanism of land contract management right, the legal rights and interests of land contractor can be protected more powerfully.
