【摘要】：隨著城市化進(jìn)程加快,城市征地加劇,失地農(nóng)民日益增加�，F(xiàn)有的征地補(bǔ)償制度存在一系列的問題,致使很多失地農(nóng)民成為種田無地、就業(yè)無崗、社保無份的“三無”人員,他們成為了城市的弱勢(shì)人群。合法權(quán)益得不到保障,失地農(nóng)民權(quán)益受損不僅傷害了失地農(nóng)民,而且影響著城市化進(jìn)程。因此,失地農(nóng)民權(quán)益保障的研究具有很重要的現(xiàn)實(shí)意義。 本文理論聯(lián)系實(shí)際,首先分析了失地農(nóng)民問題的由來,其次分析了當(dāng)前我國失地農(nóng)民的現(xiàn)狀。主要表現(xiàn)為,失地農(nóng)民規(guī)模不斷擴(kuò)大；失地農(nóng)民生活下降；失地農(nóng)民就業(yè)難；養(yǎng)老保險(xiǎn)缺失；醫(yī)療覆蓋面小。接著,進(jìn)一步深刻探析了失地農(nóng)民權(quán)益受損的原因,主要包括,城鄉(xiāng)二元結(jié)構(gòu)的制度因素；土地征收制度的缺陷；社會(huì)保障的缺失；以及失地農(nóng)民自身的因素。 在深刻剖析了失地農(nóng)民權(quán)益受損的原因后,結(jié)合我國的基本國情和經(jīng)濟(jì)狀況,提出了相關(guān)的對(duì)策建議。一是,要實(shí)現(xiàn)體制創(chuàng)新,改善城鄉(xiāng)二元結(jié)構(gòu)；二是,要建立健全我國的土地征收制度；三是,要完善社會(huì)保障制度；四是,要提高失地農(nóng)民自身素質(zhì)。 本文旨在分析失地農(nóng)民權(quán)益保障問題,是保障失地農(nóng)民合法權(quán)益、推動(dòng)經(jīng)濟(jì)健康發(fā)展、促進(jìn)城市化進(jìn)程的一個(gè)有益探索。
[Abstract]:With the acceleration of urbanization, urban land acquisition intensified, loss of land farmers are increasing. There are a series of problems in the current land expropriation compensation system, which makes many landless farmers become the "three noes" who have no land, no employment and no social security. They have become the vulnerable people in the city. Legal rights and interests can not be guaranteed, the rights and interests of landless farmers not only hurt the lost farmers, but also affect the process of urbanization. Therefore, the study of land-lost farmers' rights and interests has a very important practical significance. Combining theory with practice, this paper first analyzes the origin of the problem of land-lost farmers, and then analyzes the present situation of land-lost farmers in China. The main performance is that the scale of land-lost farmers is expanding; the life of landless farmers is declining; the employment of landless farmers is difficult; the pension insurance is missing; the medical coverage is small. Then, it analyzes the causes of the loss of farmers' rights and interests, including the system factors of urban-rural dual structure, the defects of land expropriation system, the lack of social security, and the factors of land-lost farmers themselves. After deeply analyzing the causes of the loss of land farmers' rights and interests, combined with our country's basic national conditions and economic conditions, this paper puts forward some relevant countermeasures and suggestions. First, it is necessary to achieve institutional innovation and improve the dual structure of urban and rural areas; second, to establish and improve the system of land expropriation in China; third, to improve the social security system; and fourth, to improve the quality of landless farmers themselves. The purpose of this paper is to analyze the protection of the rights and interests of the landless peasants, which is a beneficial exploration to protect the legitimate rights and interests of the landless peasants, to promote the healthy development of economy and to promote the process of urbanization.
