【摘要】：關(guān)于"法與理"的話題一直就是人們爭(zhēng)論的話題,中國(guó)自古以來(lái)就是法重于理的,但是隨著社會(huì)的不斷發(fā)展,人們多元化的價(jià)值觀的不停的變化,人們開(kāi)始重新理解理性對(duì)于刑法的意義,對(duì)于社會(huì)道德不斷變化也在不斷地進(jìn)行著重塑,因此,在現(xiàn)代這樣一個(gè)社會(huì)急劇變遷、思想多元化的時(shí)代,需要我們更加注重理性的作用,以找到這兩方面的平衡點(diǎn),達(dá)到社會(huì)的平穩(wěn)和安定。本文將會(huì)對(duì)我國(guó)古代的各種刑罰做一個(gè)簡(jiǎn)單的回顧,對(duì)理性思維進(jìn)行有關(guān)自身的一些思考,理性之于刑法的作用和意義,以及在現(xiàn)實(shí)的例子中,我們將如何人運(yùn)用理性正確看待客觀事件。
[Abstract]:The topic of "law and reason" has always been the subject of debate. Since ancient times, China has focused on law over reason, but with the continuous development of society, people's pluralistic values are constantly changing. People begin to re-understand the meaning of rationality to criminal law and to the constant changes of social morality. Therefore, in a modern age of rapid social changes and diversified thinking, We need to pay more attention to the role of reason in order to find the balance of the two aspects to achieve social stability and stability. This article will do a simple review of the ancient punishment of our country, think about the rational thinking about itself, the role and significance of rationality in criminal law, and in the actual examples, How we will use reason to view objective events correctly.
