【摘要】：少數(shù)民族文化知識(shí)產(chǎn)權(quán)保護(hù)對(duì)于少數(shù)民族傳統(tǒng)文化的保存、延續(xù)和發(fā)展具有非常重要的作用。無論是國(guó)際條約還是其他國(guó)家,都有很多關(guān)于少數(shù)民族文化知識(shí)產(chǎn)權(quán)保護(hù)的相關(guān)立法可資借鑒。由于傳統(tǒng)知識(shí)財(cái)產(chǎn)權(quán)與少數(shù)民族文化知識(shí)產(chǎn)權(quán)之間有比較大的隔閡,運(yùn)用傳統(tǒng)知識(shí)財(cái)產(chǎn)權(quán)無法完全保護(hù)少數(shù)民族文化,因此建議對(duì)少數(shù)民族文化知識(shí)產(chǎn)權(quán)保護(hù)進(jìn)行特別立法。
[Abstract]:The protection of intellectual property rights plays an important role in the preservation, continuation and development of minority traditional culture. Whether international treaties or other countries, there are a lot of relevant legislation on the protection of minority cultural intellectual property rights can be used for reference. Because there is a big gap between traditional intellectual property rights and minority cultural intellectual property rights, the use of traditional intellectual property rights can not fully protect minority cultures, so it is suggested that special legislation should be made on the protection of minority cultural intellectual property rights.
