【摘要】：城市規(guī)劃對(duì)城市土地價(jià)值產(chǎn)生巨大影響,這部分利益的分配與社會(huì)公平和效率息息相關(guān)。城市規(guī)劃利益還原是指正義地分配城市規(guī)劃帶來(lái)的土地利益改變。本文首先對(duì)城市規(guī)劃利益還原的概念內(nèi)涵進(jìn)行界定,指出它與土地增值利益還原研究在范圍與內(nèi)涵上的重合和差異。接著,對(duì)功利主義、社會(huì)公平及平等主義視角下的分配正義原則在城市規(guī)劃利益分配上的應(yīng)用進(jìn)行辨析,綜合考慮不同原則的局限性與適用性,以平等主義的正義理論為主要依據(jù),提出城市規(guī)劃利益還原的公平原則和效率原則。公平原則指受益者負(fù)擔(dān),受損者得到補(bǔ)償?shù)脑瓌t,該原則下土地權(quán)利人應(yīng)將其增值收益進(jìn)行社會(huì)共享;效率原則指為了追求效率而忍受的不平等要以實(shí)現(xiàn)最不利者的最大利益為目標(biāo),即需要滿足社會(huì)公眾對(duì)土地增值利益的共享與土地改良間接收益之和的最大化。
[Abstract]:Urban planning has a great impact on the value of urban land, which is closely related to social equity and efficiency. The restoration of urban planning benefits refers to the changes of land interests brought by the fair distribution of urban planning. This paper first defines the connotation of urban planning interest restoration, and points out the overlap and difference between it and land value-added interest restoration research in scope and connotation. Then, the application of the principle of distribution justice in the perspective of utilitarianism, social equity and egalitarianism in the distribution of urban planning benefits is analyzed, and the limitations and applicability of different principles are considered synthetically. Based on the justice theory of egalitarianism, the fair principle and efficiency principle of urban planning interest restoration are put forward. The principle of equity refers to the principle that the beneficiaries bear the burden and the injured are compensated. Under this principle, the owners of land rights should share their value-added income in society. The principle of efficiency means that the inequality endured in order to pursue efficiency should aim at realizing the best interests of the most disadvantageous, that is to say, it needs to satisfy the social public's sharing of land value-added benefits and the maximization of the sum of indirect benefits of land improvement.
