【摘要】：《蒙古—衛(wèi)拉特大法典》與《理藩院則例》、《喀爾喀法典》一同被譽(yù)為蒙古民族的三大歷史法律文獻(xiàn),包含著豐富的歷史文化內(nèi)容,但國內(nèi)外對其應(yīng)有的學(xué)術(shù)研究價值還沒有很好的挖掘出來。本文由緒言、正文和結(jié)語三大部分構(gòu)成,其中正文由五部分組成。正文的第一部分介紹了《大法典》制定前蒙古、衛(wèi)拉特內(nèi)外部所面臨的政治、經(jīng)濟(jì)社會環(huán)境;第二部分介紹了《大法典》的基本內(nèi)容,由于《大法典》正文原文既沒有篇章也沒有分成具體的條目,筆者在前人研究的基礎(chǔ)上,把《大法典》的正文部分歸納為調(diào)控蒙古與衛(wèi)拉特各部落關(guān)系、軍事攻防、獨(dú)尊喇嘛教(黃教)、畜牧與狩獵、婚姻家庭與財產(chǎn)繼承、以罰畜為主的刑事懲罰和使者與驛馬等方面內(nèi)容加以分析;第三部分分析了《大法典》具有民族性、草原文化性、宗教性、實(shí)利性和諸法合體性等法律文化特點(diǎn);第四部分闡述了《大法典》的法律淵源,認(rèn)為蒙古民族著名的《大法典》的法源來自于古代游牧蒙古民族約定成俗、世代遵守的風(fēng)俗習(xí)慣以及繼承發(fā)展了16、17世紀(jì)蒙古民族制定的《阿勒坦法典》、《白樺法典》等法律文獻(xiàn);第五部分比較了《大法典》與《成吉思汗大扎撒》兩部蒙古民族制定于不同時期的法律文獻(xiàn),從蒙古民族兩部制定時代不同的法律文獻(xiàn)比較可知,兩部法律文獻(xiàn)具有相似性,但更多的是他們之間的不同。
[Abstract]:The Mongol-Vera Code of Law, together with the Code of principles of Lifangyuan and the Code of Kalikha, are known as the three historical and legal documents of the Mongolian nation, which contain rich historical and cultural contents. However, the academic research value at home and abroad has not been well excavated. This paper is composed of three parts: introduction, text and conclusion, among which the text is composed of five parts. The first part of the text introduces the political, economic and social environment faced by Mongolia and Werat before the formulation of the Great Code, while the second part introduces the basic contents of the Great Code. Since there is neither a text nor a specific entry in the original text of the Great Code, the author, on the basis of previous studies, sums up the text of the Great Code as regulating the relations between Mongolia and the tribes of Werat, military attack and defense. The contents of Lamaism (Yellow religion), animal husbandry and hunting, marriage and family, inheritance of property, criminal punishment based on punishment of livestock and messengers and post horses are analyzed. The third part analyzes the nationality and grassland culture of the Great Code. The fourth part expounds the legal origin of the Great Code, and holds that the legal source of the famous Mongolian nationality "Great Code" comes from the ancient Mongolian nomadic people's convention and vulgarity. The customs and habits observed from generation to generation, as well as the inheritance and development of the legal documents such as the Code of Aletham and the Code of Bai Hua made by the Mongolians in the 16th and 17th centuries; In the fifth part, the author compares the two legal documents made by Mongolian nationality in different periods with "Great Code" and "Genghis Khan Great Zasa". From the comparison of the two legal documents of Mongolian nationality at different times, it can be seen that the two legal documents are similar. But more is the difference between them.
