【摘要】： 目前，我國(guó)的經(jīng)濟(jì)體制改革正處于深入發(fā)展時(shí)期，由于諸多體系尚不成熟，經(jīng)濟(jì)犯罪占到刑事犯罪相當(dāng)大的比重，極大的破壞了市場(chǎng)正常運(yùn)行機(jī)制。這其中合同詐騙犯罪更是甚為猖獗，尤其是對(duì)市場(chǎng)秩序的巨大破壞性，以及近年來(lái)案件數(shù)量的激增，已經(jīng)引起社會(huì)各界的高度重視。本文擬就合同詐騙罪的犯罪定性，罪與非罪，合同詐騙犯罪的特點(diǎn)和新趨勢(shì)作一分析，并且結(jié)合合同詐騙自身特點(diǎn)對(duì)合同詐騙案件的偵查、防范對(duì)策作一深入探討。 第一章：首先對(duì)合同詐騙犯罪的概念及其構(gòu)成進(jìn)行界定和分析，隨后對(duì)合同詐騙罪與合同民事欺詐、合同糾紛進(jìn)行區(qū)別，這就從刑法學(xué)的角度對(duì)合同詐騙犯罪的罪與非罪進(jìn)行了界定，使合同詐騙案件構(gòu)成要件更加清晰，同時(shí)對(duì)合同詐騙犯罪的社會(huì)危害性進(jìn)行闡述。 第二章：主要闡明合同詐騙犯罪的特點(diǎn)以及其犯罪新趨勢(shì)，對(duì)偵查措施、手段、犯罪證據(jù)的收集進(jìn)行了論述。其中針對(duì)電子合同詐騙這一犯罪新形式，本章在電子合同詐騙的犯罪方式、電子證據(jù)價(jià)值以及電子證據(jù)的收集這些問(wèn)題上也作了一些初步探討。 第三章：結(jié)合偵查中的實(shí)際情況，總結(jié)打擊、預(yù)防合同詐騙犯罪的經(jīng)驗(yàn)，對(duì)合同詐騙犯罪的防范問(wèn)題作一研究。 在結(jié)論部分，，就整篇論文作出總結(jié)，闡述主要觀(guān)點(diǎn)。
[Abstract]:At present, the economic system reform in our country is in a period of deep development. As many systems are still immature, economic crimes account for a considerable proportion of criminal crimes. It has greatly damaged the normal operation mechanism of the market. Among them, the crime of contract fraud is even more rampant, especially the enormous damage to the market order, and the surge in the number of cases in recent years. This article intends to make an analysis of the criminal nature, crime and non-crime, the characteristics and new trends of contract fraud crime, and the investigation of contract fraud cases according to the characteristics of contract fraud. The prevention countermeasure makes a thorough discussion. Chapter one: firstly, it defines and analyzes the concept and constitution of the crime of contract fraud, and then distinguishes the crime of contract fraud from the contract civil fraud and contract dispute. This paper defines the crime and non-crime of contract fraud from the angle of criminal law, makes the elements of contract fraud more clear, and expounds the social harmfulness of contract fraud crime. The second chapter mainly expounds the characteristics of contract fraud and its new trend of crime, discusses the investigation measures, means, and the collection of evidence of crime, among which electronic contract fraud is a new form of crime. This chapter also makes some preliminary discussions on the crime of electronic contract fraud, the value of electronic evidence and the collection of electronic evidence. Chapter three: combining the actual situation in investigation, summing up the experience of attacking and preventing contract fraud crime, and making a study on the prevention of contract fraud crime. In the conclusion part, the author summarizes the whole paper and expounds the main points.
