【摘要】：20世紀(jì)70年代以來(lái),在刑罰執(zhí)行社會(huì)化思想的導(dǎo)向下,西方發(fā)達(dá)國(guó)家試圖用更加有效、更加人道、更加文明的方式對(duì)待和處理犯罪和罪犯,對(duì)刑罰執(zhí)行制度進(jìn)行不停地創(chuàng)新和改革,經(jīng)過(guò)半個(gè)世紀(jì)的不斷完善與發(fā)展,一種新型的刑罰執(zhí)行方式和罪犯處理模式應(yīng)運(yùn)而生并得到日趨完善----社區(qū)矯正制度。社區(qū)矯正制度漸漸的成了改造罪犯的首選方案,并且取得了良好的社會(huì)效果,目前使用社區(qū)矯正制度的罪犯人數(shù)越來(lái)越多。 社區(qū)矯正,是刑罰執(zhí)行制度改革的一項(xiàng)重要內(nèi)容。社區(qū)矯正無(wú)論從理論層面還是實(shí)務(wù)層面都順應(yīng)了國(guó)際行刑發(fā)展的潮流。我國(guó)社區(qū)矯正的試點(diǎn)于2002年在上海率先起步,各試點(diǎn)省(市)特別是全國(guó)首批試點(diǎn)的6個(gè)省(市),根據(jù)公安部、最高人民檢察院、最高人民法院、司法部在《關(guān)于開展社區(qū)矯正工作的通知》的文件精神和要求,結(jié)合當(dāng)?shù)貙?shí)際,陸續(xù)制定出臺(tái)了具體的社區(qū)矯正工作意見和實(shí)施方案,整體規(guī)劃和部署試點(diǎn)實(shí)踐,著力推動(dòng)試點(diǎn)工作發(fā)展。在實(shí)踐探索中,一個(gè)突出的問(wèn)題就是：社區(qū)矯正對(duì)象的就業(yè)促進(jìn)問(wèn)題如何解決? 社區(qū)矯正對(duì)象安居樂(lè)業(yè)有利于他們回歸社會(huì),減少重新犯罪的動(dòng)因,對(duì)維護(hù)社會(huì)正常秩序和人民群眾生命財(cái)產(chǎn)安全起到重要的作用。本文以瑞安市社區(qū)矯正制度框架為研究對(duì)象,在分析瑞安市社區(qū)矯正對(duì)象就業(yè)現(xiàn)狀、面臨的困難和問(wèn)題的基礎(chǔ)上,從社會(huì)資本這一角度尋求促進(jìn)社區(qū)矯正對(duì)象就業(yè)的途徑和制度架構(gòu),試圖在現(xiàn)有的制度架構(gòu)下使得社區(qū)矯正對(duì)象的就業(yè)促進(jìn)工作更具有指導(dǎo)性和可操作性。
[Abstract]:Since 1970s, under the guidance of the socialization of penalty execution, the western developed countries have tried to deal with crimes and criminals in a more effective, humane and civilized way. After half a century of continuous improvement and development, the system of penalty execution has been constantly innovated and reformed. A new type of punishment execution mode and criminal handling mode came into being and got increasingly consummated the community correction system. The community correction system gradually became the first choice for reforming criminals, and achieved good social effect. At present, the number of criminals using community correction system is increasing. Community correction is an important part of the reform of penalty enforcement system. Community correction conforms to the trend of international execution both theoretically and practically. In 2002, the pilot project of community correction in China took the lead in Shanghai. According to the spirit and requirements of the documents of the Ministry of Public Security, the Supreme people's Procuratorate, the Supreme people's Court, and the Ministry of Justice in the Circular on the Development of Community Corrections, In combination with local realities, specific community correction work opinions and implementation plans have been formulated one after another, the overall planning and deployment of the pilot practice has been made, and efforts have been made to promote the development of the pilot work. A prominent problem is: how to solve the employment promotion problem of the community correction object? Community correction objects in peace and contentment can help them to return to society and reduce the motivation of reoffending. It plays an important role in maintaining normal social order and the safety of people's life and property. This paper takes the framework of community correction system in Ruian city as the research object, and analyzes the present employment situation of the community correction objects in Ruian city. On the basis of the difficulties and problems, we seek ways and institutional framework to promote the employment of community correction objects from the perspective of social capital. This paper tries to make the employment promotion of community correction objects more instructive and operable under the existing system framework.
