【摘要】：憲政體制變革的動力,源于新舊利益集團在政治博弈中對權(quán)力邊界的制度化訴求。20世紀(jì)90年代以來,隨著軍人集團的沒落,以及城市中產(chǎn)階級與新資本集團的相繼興起,泰國憲政體制在各派利益集團的持續(xù)沖突與妥協(xié)中不斷重構(gòu)。通過完善公民政治權(quán)利、提高地方自治、加強立法權(quán)與行政權(quán)制衡、創(chuàng)設(shè)獨立監(jiān)督體系等制度建設(shè),泰國的憲政架構(gòu)開始從一元轉(zhuǎn)向多元。盡管從短期來看,由于憲政體制與權(quán)力結(jié)構(gòu)的錯位,各派利益集團將圍繞修憲議題展開針鋒相對的政治博弈,從而引發(fā)社會分裂與政治動蕩,但從中長期來看,隨著政治權(quán)力結(jié)構(gòu)日趨多極化,泰國憲政體制將在"權(quán)力制衡"的多元化道路上繼續(xù)前行,進而為社會經(jīng)濟發(fā)展提供平穩(wěn)有序的政治環(huán)境。
[Abstract]:The motive force of the constitutional system reform originates from the institutionalization of the power boundary in the political game between the old and the new interest groups. Since the 1990s, with the decline of the military group and the rise of the urban middle class and the new capital group one after another, Thailand's constitutional system is constantly reconstructed in the continuous conflict and compromise of various interest groups. Through the improvement of civil political rights, the enhancement of local autonomy, the strengthening of checks and balances between legislative power and executive power, and the establishment of independent supervisory system, the constitutional structure of Thailand began to change from monism to pluralism. Although in the short term, due to the dislocation of the constitutional system and the power structure, various interest groups will launch a tit-for-tat political game around the issue of constitutional amendment, which will lead to social division and political turmoil, but in the medium and long term, With the political power structure becoming more and more polarized, Thailand's constitutional system will continue to move forward on the pluralistic road of "power checks and balances", thus providing a stable and orderly political environment for the social and economic development.
