【摘要】："共和主義"一方面強(qiáng)調(diào)個(gè)人自由、另一方面又主張個(gè)人自由唯有在奉行法治的政治共同體中方有存在和伸展的空間。作為一個(gè)正在建設(shè)社會(huì)主義法治國(guó)家、謀求全民共同福祉的共和國(guó),我國(guó)法律與政治學(xué)界恰應(yīng)從共和主義傳統(tǒng)中汲取思想資源,而不是在個(gè)人主義與國(guó)家主義的極端立場(chǎng)中各執(zhí)一端、劍走偏鋒。本文試圖回到共和憲制的源頭,分析和梳理"共和主義鼻祖"西塞羅的憲法與法治理念,以期為共和主義憲法理論在我國(guó)的立基提供一片磚瓦。
[Abstract]:On the one hand, "republicanism" emphasizes individual freedom, on the other hand, it advocates that individual freedom can only exist and extend in the political community under the rule of law. As a republic that is building a socialist country under the rule of law and seeking the common welfare of the whole people, the legal and political circles of our country should draw ideological resources from the tradition of republicanism. It is not in the extreme position of individualism and nationalism that the sword deviates from each other. This paper attempts to return to the source of the Republican constitution, and analyzes and combs Cicero's constitution and the concept of the rule of law in order to provide a brick for the Republican constitutional theory in our country.
