翻譯轉(zhuǎn)移是一種普遍存在于各類文體翻譯中的現(xiàn)象,如在中文立法文本的英譯。然而,學(xué)術(shù)界幾乎沒有對中英互譯中的翻譯轉(zhuǎn)移現(xiàn)象進(jìn)行分析,更談不上在法律翻譯中研究翻譯轉(zhuǎn)移。為此,本文嘗試對立法文本英譯之中的翻譯轉(zhuǎn)移進(jìn)行描述性研究。本文提出了三個研究問題:1.在立法文本英譯之中存在哪些種類的翻譯轉(zhuǎn)移? 2.判斷翻譯轉(zhuǎn)移的適當(dāng)與否,需要哪些標(biāo)準(zhǔn)?3.翻譯轉(zhuǎn)移是否遵從提出的標(biāo)準(zhǔn)? 本文把翻譯轉(zhuǎn)移定義為“在譯文中所有異于原文的表達(dá)方式,或所有沒有如理想般出現(xiàn)的表達(dá)方式”,且本文闡明翻譯轉(zhuǎn)移分析應(yīng)當(dāng)是描述性的而不是規(guī)定性的。中文立法文本英譯的翻譯轉(zhuǎn)移可從微觀角度和宏觀角度分析。微觀層次的翻譯轉(zhuǎn)移可分為層次轉(zhuǎn)移、單位轉(zhuǎn)移、結(jié)構(gòu)轉(zhuǎn)移、類型轉(zhuǎn)移和系統(tǒng)轉(zhuǎn)移,而宏觀層次的翻譯轉(zhuǎn)移可分為語義轉(zhuǎn)移和語用轉(zhuǎn)移。本文繼而試圖提出兩個標(biāo)準(zhǔn)以衡量翻譯轉(zhuǎn)移的適當(dāng)性:語言標(biāo)準(zhǔn)和法律標(biāo)準(zhǔn)是評判翻譯轉(zhuǎn)移的可接受性的準(zhǔn)則。 本文從幾部中文法律和法規(guī)中選取眾多范例,用提出的分類和框架和Munday設(shè)計的格式按翻譯轉(zhuǎn)移的類型加以分析。本文證實了在中文立法文本英譯之中存在著七類翻譯轉(zhuǎn)移,并確...
