【摘要】：近期,俗稱“水十條”的《水污染防治行動計劃》出臺,飲用水安全再次成為大家關(guān)心的焦點,然而《計劃》重點旨在保護城市飲用水安全,對農(nóng)村的飲用水安全存在一定程度的忽略。在當(dāng)前農(nóng)村發(fā)展進(jìn)程中,一方面工業(yè)和城市的污染正向農(nóng)村轉(zhuǎn)移排放;另一方面,來自農(nóng)業(yè)本身的污染也相當(dāng)驚人:化肥、農(nóng)藥等農(nóng)業(yè)投入品過量使用,畜禽糞便、農(nóng)作物秸稈和農(nóng)田殘膜等農(nóng)業(yè)廢棄物不合理處置,曾經(jīng)的“田園凈水”正經(jīng)歷各類污染的侵害,農(nóng)村飲用水安全正拉響警報。因此運用法律手段保護農(nóng)村飲用水水源地成為保障農(nóng)村飲水安全,促進(jìn)農(nóng)業(yè)生產(chǎn)、農(nóng)村發(fā)展、農(nóng)民安全的必然選擇。本文主要包含五個部分:第一部分為“引言”,簡要地闡述了論文的選題背景、選題意義、研究現(xiàn)狀和研究目的;第二部分為“農(nóng)村飲用水水源地的概述”,該部分首先在對比了有關(guān)飲用水水源的概念上,分析當(dāng)前我國農(nóng)村飲用水水源地的特點及保護上存在的問題,其次從保護農(nóng)村飲用水水源地的法律價值與現(xiàn)實意義兩個方面闡述了關(guān)注農(nóng)村飲用水水源地保護的意義,最后分析了我國農(nóng)村飲用水水源地法律保障制度的歷史沿革;論文第三部分至第五部分,分別是飲用水水源監(jiān)管機制、農(nóng)村飲用水水源地保護區(qū)制度、農(nóng)村飲用水水源地面源污染防治機制和飲用水水源應(yīng)急預(yù)警機制這四個主要保障農(nóng)村飲用水安全的法律制度,對這四個具體法律制度分別分析了執(zhí)行情況、所存在的問題以及如何進(jìn)行進(jìn)一步的完善;最后部分為“結(jié)語”,簡要概括了本論文所得出的結(jié)論及不足之處。
[Abstract]:Recently, the Water pollution Prevention and Control Action Plan, commonly known as "10 articles of Water," was issued. Drinking water safety has once again become the focus of attention. However, the focus of the Plan is to protect the safety of drinking water in cities. The safety of drinking water in rural areas is neglected to a certain extent. In the current process of rural development, on the one hand, industrial and urban pollution is shifting to the rural areas; on the other hand, the pollution from agriculture itself is quite alarming: excessive use of agricultural inputs such as fertilizers and pesticides, livestock and poultry manure, Agricultural wastes such as crop straw and farmland residue film are being disposed of unreasonably, once "farm clean water" is going through various kinds of pollution encroachment, rural drinking water safety is sounding the alarm. Therefore, the use of legal means to protect rural drinking water sources has become an inevitable choice to ensure rural drinking water safety, promote agricultural production, rural development and farmers' safety. This paper mainly includes five parts: the first part is "introduction", which briefly describes the background, significance, research status and purpose of the thesis, and the second part is "Overview of rural drinking water sources". This part first compares the concept of drinking water source, analyzes the characteristics of drinking water source in rural areas and the problems in protection. Secondly, it expounds the significance of paying attention to the protection of rural drinking water sources from two aspects of the legal value and practical significance of protecting rural drinking water sources, and finally analyzes the historical evolution of the legal protection system of rural drinking water sources in China. The third to fifth parts of the paper, respectively, are the drinking water source supervision mechanism, rural drinking water source protection area system, The four main legal systems to ensure the safety of rural drinking water are the prevention and control mechanism of non-point source pollution in rural drinking water sources and the emergency warning mechanism of drinking water sources. The implementation of these four specific legal systems is analyzed separately. The last part is "conclusion", which briefly summarizes the conclusions and shortcomings of this paper.
