【摘要】：20世紀(jì)80年代之前知識產(chǎn)權(quán)反壟斷案件大多不需要界定相關(guān)市場。20世紀(jì)80年代之后,隨著知識經(jīng)濟(jì)的出現(xiàn),反壟斷法對知識產(chǎn)權(quán)濫用行為的態(tài)度發(fā)生了轉(zhuǎn)變,知識產(chǎn)權(quán)反壟斷案件中相關(guān)市場界定的特殊性逐漸受到關(guān)注,出現(xiàn)了技術(shù)市場、創(chuàng)新市場等概念,另外,自然壟斷行業(yè)的關(guān)鍵設(shè)施理論也擴(kuò)大適用至現(xiàn)代知識產(chǎn)權(quán)反壟斷領(lǐng)域,并對知識產(chǎn)權(quán)反壟斷案件中的相關(guān)市場界定產(chǎn)生了一定影響。
[Abstract]:Before the 1980s, most intellectual property antitrust cases did not need to define the relevant market. After the 1980s, with the emergence of knowledge economy, the attitude of the anti-monopoly law to the abuse of intellectual property has changed. The particularity of the definition of relevant markets in intellectual property rights antitrust cases has been gradually concerned, and the concepts of technology market and innovative market have emerged. In addition, the theory of key facilities in natural monopoly industry has also been extended to the field of modern intellectual property rights antimonopoly. And to intellectual property rights anti-monopoly cases in the relevant market definition has a certain impact.
