從文體學(xué)角度看中文合同的英譯

隨著改革開(kāi)放的不斷深化和申請(qǐng)入世的成功,我國(guó)在國(guó)際經(jīng)濟(jì)活中活力倍增,與世界許多國(guó)家的經(jīng)貿(mào)交流和合作日益頻繁。 在涉外經(jīng)濟(jì)與商業(yè)合作中,雙方通過(guò)談判或函電協(xié)商達(dá)成協(xié)議后,大都需要另行簽訂正式的書(shū)面文件—合同,以作為某項(xiàng)法律行為成立的依據(jù)。這類(lèi)合同需要英漢兩種版本,因此大多需要翻譯。 在合同翻譯實(shí)踐中,筆者發(fā)現(xiàn)中文合同英譯是一個(gè)難點(diǎn),因?yàn)楹贤⒄Z(yǔ)不同于日常英語(yǔ),專(zhuān)業(yè)性極強(qiáng),表現(xiàn)出獨(dú)特的文體特征。有鑒于此,筆者在研讀有關(guān)著述和論文的基礎(chǔ)上,從合同的界定及合同英語(yǔ)的文體特征入手,著重探討了合同英譯的標(biāo)準(zhǔn)、技巧以及對(duì)合同譯者的要求等諸方面,意在拋磚引玉,受教于大方之家,亦希望能對(duì)這一領(lǐng)域的翻譯進(jìn)行深入討論。 本文共分為五章。 第一章是合同概述,簡(jiǎn)要介紹了合同的定義、種類(lèi)和結(jié)構(gòu),旨在為下文論述打下一個(gè)背景基礎(chǔ)。第二章基于文體學(xué)概念和文體學(xué)研究的必要性,概括出合同英語(yǔ)的四個(gè)文體特征,并從詞匯、語(yǔ)法和語(yǔ)義方面分別舉例論證,為探討中文合同的英譯奠定了基礎(chǔ)。第三章是中國(guó)傳統(tǒng)翻譯標(biāo)準(zhǔn)與西方翻譯標(biāo)準(zhǔn)的比較。通過(guò)比較,這一章為下一章的進(jìn)一步分析和發(fā)現(xiàn)提供了理...
