【摘要】：國家監(jiān)督權(quán)的分散配置是當前監(jiān)察體制諸多弊病之根源,監(jiān)察體制改革所欲達致的目標即為實現(xiàn)機構(gòu)與職能的整合,以期優(yōu)化監(jiān)督權(quán)的配置模式�；诒O(jiān)察體制改革的屬性、背景與內(nèi)涵,改革須遵循先"變法"后"變革"的邏輯,且應(yīng)以人民代表大會制度為根本遵循,還須遵照機構(gòu)與職能整合的思路,以及監(jiān)察權(quán)獨立行使的理念。以此為指引的改革,需適時啟動相關(guān)法律的"立改廢"工作,處理好監(jiān)察委員會與其他國家機關(guān)的關(guān)系,合理安排監(jiān)察委員會的組織結(jié)構(gòu)與職權(quán),并建立監(jiān)察權(quán)行使的監(jiān)督與制約機制。
[Abstract]:The decentralized allocation of the state supervision power is the root of many defects of the current supervisory system. The goal of the supervisory system reform is to realize the integration of the organization and the function in order to optimize the allocation mode of the supervisory power. Based on the nature, background and connotation of the reform of the supervisory system, the reform should follow the logic of "reform" before "reform", and should be based on the system of the people's Congress, and should also follow the train of thought of the integration of institutions and functions. And the concept of independent exercise of supervisory power. The reform guided by this should start the work of "reform and repeal" of relevant laws at the right time, handle the relationship between the supervisory committee and other state organs, and rationally arrange the organizational structure and powers of the supervisory committee. And establish the supervision and restriction mechanism of the exercise of supervisory power.
